All holidays on our website are
operated by ‘Thailex Travel’ and our local agent (hereinafter called ‘the company’, ‘us’ or ‘we’) and are sold
subject to the following conditions. By booking with us you accept and
are bound by these conditions. Please ensure you have read the
itineraries of the trip you are booking. Note that additional booking
conditions may apply if you book through one of our overseas agents.
Booking: complete the on-line booking form and pay a deposit of
20% of the total costs or drop us an email and we will contact
you without delay. Any changes that you subsequently make will be subject to an
amendment fee.
Late bookings: if your trip is less than 8 weeks before
departure, full payment is due on booking, and we reserve the right to
levy a late booking fee of 1,000 Thai Baht to cover extra expenses.
Confirmation: your booking will normally be confirmed within 7
days and with your confirmation we will send you all the relevant
information and travel documents.
Amendment Fees: change of your holiday to another departure date
or another trip featured on our website or in our current brochure, the
following fee will apply: transfer between time of booking and 8 weeks
prior to departure: 1,500 Thai Baht per person; if less than 8 weeks to day of
original departure: charges as per cancellation fees.
Cancellation and Refunds: if you cancel your booking the
following fees will apply; more than 8 weeks prior to departure: loss of
deposit; between 4 to 8 weeks prior to departure: 50% of total costs;
less than 4 weeks prior to departure: 100% of total costs. No refunds
will be made if you do not show up for a trip at the specified place and
time or leave a tour for any reason whatsoever, whether voluntarily or
involuntarily, after the trip has begun. No refunds will be made for any
of the items or services not utilized. We will not cancel your booking
unless the minimum number of bookings needed to operate the tour has not
been reached. We will advise you of the cancellation no later than 4
weeks before the departure date of the tour.
Final Payment: the balance of your payment is due 8 weeks
before departure. We will send you an e-invoice with which you
can pay the remainder on-line,
that is: the full trip expense
minus the advanced payment. The date due is shown on your e-invoice: we do
not usually send reminders. If you do not pay your balance at
the specified time, without making prior arrangements with us we
reserve the right to cancel your booking. We reserve the right
to impose surcharges at any time before departure due to unfavourable changes in exchange rates, increases in airfares or
other forms of transportation, or accommodation costs. If any
surcharge greater than 10% of the total tour cost is imposed,
you have the right to cancel your booking within 7 days of
receiving such notification. All our rates are exclusive of
flight to Thailand and inclusive of 7% local governmental taxes
(VAT). For every first
booking we charge an administration fee of 500 Thai Baht per
dossier.
Responsibilities: the outlined itineraries given for each tour
must be taken as an indication of what should be accomplished and
therefore allow alternatives and a certain degree of on-tour
flexibility. Changes in itinerary or accommodation may occur due to
hotel availability and room occupancy, or unforeseeable circumstances.
The company shall not be liable for any damages caused by the total or
partial failure to carry out the contract if such failure is:
attributable to the passenger; or unforeseeable, or unavoidable and
attributable to a third party unconnected to the company; or a result of
unusual and unforeseeable circumstances beyond the control of the
company, such as strikes, war, civil or political unrest, quarantine
restrictions, government action, acts of God, or what is usually known
as ‘force majeure’; or as a result of an event that the company and its
agents even with all due care could not foresee or forestall. Where the
company is found to be liable for damages in respect of its failure to
carry out the contract, the maximum amount of such damages will normally
be limited to the price paid for the tour. Where the damages relate to
the provision of transport by air, sea or rail, or hotel accommodation,
any compensation payable will further limited by the Warsaw Convention
as amended by the Hague protocol 1955 (air), the Athens Convention 1974
(sea), the Bern Convention 1961 (rail), the Paris Convention 1962 (hotel
accommodation). Any independent arrangements that you make which are not
included in the tour cost are entirely at your own risk. Any flights
forming part of the holiday arrangements are subject of the conditions
of the carrying airline, which in most cases limit the airlines’
liability to the passenger in accordance with International Law and
conventions. Our responsibility in respect of air travel is similarly
limited to the airlines’ conditions of carriage, and in particular, we
shall not be responsible for flight delays or their results, including
the consequent amendment or curtailment of planned itineraries.
Insurance: to protect you and us we advise that you take out an
insurance policy to cover cancellation by you, and the cost of
assistance, including repatriation, in the event of accident or illness. |
